Jose A. Gutierrez is a Partner with the Firm. Mr. Gutierrez will be in charge of the firm’s Tampa office in addition to having a significant presence in the Miami office. He has successfully tried numerous personal injury and wrongful death cases to verdict throughout the State of Florida. In addition to his trial advocacy experience, he has prepared appellate briefs in every appellate court of the State of Florida, including the Supreme Court of Florida, and has presented appellate arguments in the First, Second, Third, and Fourth District Courts of Appeal. Prior to joining the firm Mr. Gutierrez was a Partner and Shareholder at Melkus, Fleming and Gutierrez. His practice concentrates on civil defense, premises liability, as well as catastrophic accident cases involving railroad, trucking and intermodal accident cases.

Education
Mr. Gutierrez graduated from the University of Florida in 1988 and the University of Miami School of Law in 1992. He was admitted to the Florida Bar in 1992 and is authorized to practice in the United States District Court for the Southern, Middle, and Northern Districts of Florida and the United States Court of Appeals for the Eleventh Circuit.
Areas of Expertise
Mr. Gutierrez was born in Havana, Cuba and lived in Spain before immigrating to the United States. He speaks and writes Spanish fluently. Mr. Gutierrez began his legal career as a Judge Advocate in the United States Marine Corps where he tried numerous courts-martials as a prosecutor. He attained the rank of Major in the Marine Corps and received an honorable discharge.
Mr. Gutierrez has been a member of the United States Navy League, Tampa Council and served as its president during 2011 and 2012. He is a member of the National Association of Railroad Trial Counsel and the Hillsborough County Bar Association.
